2.1 Appointment as Agent and Authority
Seller appoints Déjà Décor as Seller’s limited agent for the purpose of:
- marketing and facilitating the sale of listed items
- collecting buyer payments at checkout
- collecting applicable GST/HST from buyers
- arranging delivery with Déjà Décor’s delivery partner
- remitting payouts to Seller after successful completion
2.2 Seller Tax Status Representation
Seller represents and warrants that one of the following applies:
- Non-registrant: Seller is not registered for GST/HST and does not have a GST/HST number
- Registrant: Seller is registered for GST/HST and provides a valid GST/HST number
Seller agrees to keep this information accurate and up to date.
2.3 GST/HST Handling on Sales to Buyers
Déjà Décor will charge and collect applicable GST/HST from buyers on taxable sales made through the platform and will account for and remit GST/HST as required under applicable Canadian law, including Canada Revenue Agency rules applicable to agents and any elections in effect between Seller and Déjà Décor.
2.4 GST506 Election (Registrant Sellers)
If Seller is registered for GST/HST, Seller agrees — as a condition of listing — to execute CRA Form GST506 (Election Between Agent and Principal) with Déjà Décor, effective as of the listing date or another agreed effective date.
Both parties will retain a copy of the executed election in their records.
2.5 Platform Fee
Seller agrees to pay Déjà Décor a platform fee equal to 10% of the item selling price, excluding delivery charges and excluding GST/HST.
Tax treatment of the platform fee:
- For GST/HST-registered sellers under a GST506 election, Déjà Décor will charge GST/HST on the platform fee
- For non-registrant individual sellers, GST/HST does not apply to the platform fee
2.6 Payout Timing
Buyer payments are held securely by Déjà Décor.
Payouts are released after successful completion of delivery.
Payouts are processed weekly for completed transactions.
2.7 Deductions and Adjustments
Déjà Décor may deduct from payouts, where applicable:
- platform fees
- delivery costs incurred due to seller-provided inaccuracies (such as incorrect access information or missed availability)
- refunds or partial refunds
- chargebacks
- amounts otherwise owed by Seller to Déjà Décor
2.8 Seller Obligations
Seller agrees to:
- list only eligible pre-loved furniture that complies with Déjà Décor’s platform rules
- provide accurate pickup address, access notes, and availability windows
- ensure listed items match their descriptions and photos
- disclose known flaws, repairs, wear, stains, scratches, wobble, missing parts, smoke exposure, pet exposure, or other material condition details
- make items available for pickup as scheduled
Seller must not list:
- brand-new furniture
- new inventory
- items with unclear or suspicious ownership
- items with pest or infestation risk
- items with strong mould or smoke odours
- items that cannot be safely transported under Déjà Décor’s standard handling rules
Failure to comply may result in listing removal, rescheduling costs, cancellation, payout adjustments, or account restrictions.
